(Form of education: medical courses, Group 1, Item 2 according to the points table constituting Appendix No. 3 to the Regulation of the Polish Minister of Health of 6 October 2004 on the methods of fulfilling the obligation of continuing professional development by physicians and dentists, Journal of Laws No. 231, Item 2326.) In accordance with the requirements of Resolution No. 104/05/IV of the Supreme Medical Council of 11 February 2005 concerning the methods, conditions and procedures for entering entities providing continuing professional education for physicians and dentists in the register maintained by the Regional Medical Chamber, as well as the rules for maintaining such a register and accrediting forms of education, §4(2), these Regulations cover: Organisation and format of education Rules and procedures for participant enrolment Rights and obligations of participants Responsibilities of lecturers and other persons providing theoretical and practical instruction Assessment of learning outcomes Confirmation of completion of education and continuing education credits Fees for participation in education Additional provisions – registration and payment terms 1. ORGANISATION AND FORMAT OF EDUCATION Training courses are organised in Poland by Fizjoterapia i Klinika Stomatognatyczna Dr Małgorzata Kulesa-Mrowiecka, a private business operating under the name Fizjoterapia i Klinika Stomatognatyczna Dr Małgorzata Kulesa-Mrowiecka (abbreviated name: FK Stomatognatyczna), with its registered office at K. Ujejskiego 3. The registered office does not constitute a training centre. Courses are held throughout Poland, in selected locations and on dates specified in the training calendar. In order to provide the dental community with broad and convenient access to the training programme, training facilities consist of conference rooms rented for the duration of individual courses in local hotels or other institutions/facilities appropriate for the nature of the training, including medical centres and dental practices. Courses may take the form of theoretical presentations, workshops, or lectures combined with practical exercises, depending on the subject matter and technical possibilities. Lecture-based courses include multimedia and VCD/DVD presentations using multimedia projectors, large screens and sound systems. They focus on a selected treatment method or technique and, depending on the subject matter, may also include practical demonstrations using a large screen and camera systems connected to the projector. Courses are interactive. Participants have the opportunity to ask questions and take part in discussions during or after the lecture. Courses consisting of lectures combined with practical exercises are conducted in small groups of up to 20 participants. They include both theoretical instruction and practical exercises. During the practical part, all participants work simultaneously under the supervision of instructors, using the necessary instruments and materials. Workstations are equipped according to the requirements of the specific training programme. Courses are conducted in person and may last one or several days, depending on the subject and nature of the course. 2. RULES AND PROCEDURES FOR PARTICIPANT ENROLMENT Information about courses is published, among other places, in nationwide specialist publications and on specialist online platforms. Information is also distributed by email using the organiser's own database and individually upon request from interested persons. Registrations are accepted by telephone, fax and online, including through the electronic registration form available on the organiser's website. If the number of interested participants exceeds the organisational or venue capacity, a waiting list will be created. Places are allocated according to the order in which registrations and payments are received. Persons on the waiting list will be informed immediately by the organiser if a place becomes available on the main participant list. Detailed conditions governing registration and acceptance of applications are provided below in the section ADDITIONAL PROVISIONS – REGISTRATION AND PAYMENT TERMS. 3. RIGHTS AND OBLIGATIONS OF PARTICIPANTS Access to courses is open and is not subject to restrictions based on specialisation or membership, except for courses organised in successive levels, where participation in Level II may require prior confirmation of completion of Level I. Participation in a course is determined by registration accepted by the organiser and confirmed within the specified period by payment of the applicable fee. Invoices for payments are issued on the basis of information provided by the participant at the time of registration, either verbally (e.g. by telephone) or in writing (e.g. by letter, fax, electronically or via the registration form on the organiser's website). Invoices are sent by post or provided personally on the day of the course. Participants are required to register immediately before the start of the course at the designated and clearly marked course reception desk located near the lecture room. Immediately before the course begins, participants receive materials for taking notes and, where provided by the lecturer, a course outline/manual and/or CD/DVD. Seats in the lecture room are not numbered. Upon completion of the course, participants receive a certificate confirming their participation. Detailed rules concerning registration, cancellation and fees are provided in the section ADDITIONAL PROVISIONS – REGISTRATION AND PAYMENT TERMS. In the event of any dispute, these Regulations shall constitute the governing document. 4. RESPONSIBILITIES OF LECTURERS AND OTHER PERSONS PROVIDING THEORETICAL AND PRACTICAL INSTRUCTION Lecturers are required to provide the organiser, sufficiently in advance, with the training programme or any modifications thereto for publication. The programme must be delivered within the time frame, dates and locations agreed with the organiser. Lecturers are required to provide, sufficiently in advance, the contents of the course outline/manual and/or CD/DVD, or any modifications thereto, where additional course materials are provided, so that they may be prepared graphically and reproduced if necessary. Lecturers must also provide a model knowledge assessment test covering the course material. Lecturers are required to comply with all detailed arrangements agreed with the organiser and, indirectly, with participants. Lecturers are required to be punctual and comply with the announced course schedule. Lecturers must make every effort to ensure that the course is based on current medical and dental knowledge and developments, as well as their own clinical experience, while respecting the principles of Evidence-Based Medicine (EBM) and copyright applicable to the materials presented. Lecturers should focus on the working method, technique or procedure constituting the main subject of the course. Products used may be presented for illustrative purposes, including the lecturer's own equipment or material preferences, where justified by the subject of the course. Lecturers must conduct classes in direct interaction with participants and reserve sufficient time to clarify doubts, answer questions and enable discussion, either during or at the end of the course. Lecturers conducting workshops or practical exercises involving patients must hold the appropriate qualifications authorising them to provide healthcare services and must ensure appropriate clinical conditions. Lecturers conducting workshops or practical exercises are also required to continuously supervise and guide individual participants and remain available to provide answers, instructions and advice concerning questions or problems arising during practical work. At the beginning of the course, lecturers must inform participants that a short written knowledge assessment test will be conducted at the end of the course. The test is intended to evaluate learning outcomes and constitutes the basis for awarding continuing education credits. The test is administered and assessed by the lecturer or, where applicable, by the organiser using an answer key supplied by the lecturer. A scientific director is appointed by the organiser unless the lecturer designates another person sufficiently in advance who possesses appropriately documented qualifications and an academic degree (minimum: Doctor of Medical Sciences and Polish citizenship). An independent lecturer delivering an original programme may simultaneously act as the scientific director of their own medical course, provided that they hold the required academic degree. The lecturer, course content and organiser may be evaluated by participants through a voluntary written questionnaire. The lecturer and course content may also be observed and evaluated by the scientific director, depending on the circumstances. 5. ASSESSMENT OF LEARNING OUTCOMES Since March 2007, courses for which continuing education credits are awarded have been subject to a formally required and documented assessment of acquired knowledge. The organiser has adopted a short written pass/fail test covering the material presented by the lecturer as the method of knowledge assessment. Participants are informed about the test in the officially published course programme and by the lecturer at the beginning of the course. The assessment takes place at the end of the course. In addition to the test, theoretical courses provide participants and lecturers with opportunities to ask questions and participate in discussions. Practical and workshop courses involve, wherever possible, simultaneous practical work by all participants under the supervision and with the assistance of the instructor. In addition to the test, they also provide opportunities for questions and discussion. 6. CONFIRMATION OF COURSE COMPLETION AND CONTINUING EDUCATION CREDITS All types of courses are documented upon completion by an appropriate certificate of participation issued by the organiser on the basis of the attendance list, provided that the applicable fee has been paid and the participant has passed the written test. Attendance lists and completed tests are retained at the organiser's office and also constitute the basis for preparing post-course reports submitted to the relevant Medical Chambers. The certificate includes the following information: participant's full name and professional/academic title; title of the course; participant's PESEL identification number; date and location of the course; lecturer's full name and professional/academic title; lecturer's signature; where applicable, signature of the scientific director; name of the organiser; information concerning accreditation of the organiser and the course, including the entity's registration number in the relevant register, the number of training hours/continuing education credits and the participant's professional licence number; on the reverse side: an approximate hourly schedule of the course forming the basis for calculating the applicable number of continuing education credits. Due to the type of accreditation held by the organiser and its registration as an entity primarily providing postgraduate education for dentists (No. 59-000078-002-000x), the organiser reserves that recognition of continuing education credits obtained during courses organised by Fizjoterapia i Klinika Stomatognatyczna Dr Małgorzata Kulesa-Mrowiecka by physicians and/or members of other healthcare professions remains at the discretion of the relevant Medical Chamber or other authority responsible for verifying the participant's continuing professional development. 7. FEES FOR PARTICIPATION IN EDUCATION Course participation fees are determined by the organiser based on the calculated costs of preparing and conducting each course. For one-day courses, the standard fee covers organisational and educational expenses, including, among other things: rental of a conference room or clinical office; rental or depreciation of multimedia equipment and, where applicable, operator costs; teaching materials; stationery and note-taking materials; lecturer's fee; where applicable, lecturer's travel and accommodation expenses; applicable licence fees, depending on the programme; meals. For multi-day courses, depending on the applicable conditions, alternative pricing options may be calculated to include accommodation and additional meals, from which participants may choose. Each course has a specified fee or range of fee options depending on its type. Course types include: multi-day lecture-based courses; multi-day courses combining theoretical and practical components. Detailed information is provided below under ADDITIONAL PROVISIONS – REGISTRATION AND PAYMENT TERMS. 8. ADDITIONAL PROVISIONS – REGISTRATION AND PAYMENT TERMS Agreement for the Provision of Organisation and Participation Services for Postgraduate Training for Dentists A reservation made by the Client shall be regarded as an offer to enter into an agreement with Fizjoterapia i Klinika Stomatognatyczna Dr Małgorzata Kulesa-Mrowiecka for the organisation of participation in postgraduate training intended for dentists, physiotherapists, dental technicians, auxiliary personnel working in dental practices (including dental assistants and dental hygienists) and/or students. A reservation may be made verbally, for example by telephone, or in writing, including electronically, by letter or by fax. Following a reservation, the Client receives verbal or written confirmation from the organiser's office that the reservation has been accepted, together with the applicable conditions and information concerning registration for the particular course or participation in the training programme. Such confirmation shall in each case constitute preliminary confirmation of the reservation. The person making the reservation does so on their own behalf and on behalf of all participants included in the reservation. That person assumes responsibility for compliance with the reservation and registration conditions by all such participants. This also applies to financial responsibility for any accommodation, meals and additional charges exceeding the standard package where the organiser has acted as an intermediary between the Client and a hotel, centre or other entity. Following the reservation, the Client shall receive, as soon as reasonably possible, information concerning payment conditions and detailed organisational information if they have not already reviewed such information. Payment for Participation in a Course or Training Programme After receiving organisational information from the organiser's office, the Client is required to pay the applicable participation fee within the specified period and in the amount indicated by the organiser. The amount may include non-refundable reservation fees as well as full fees or additional payments associated with reservation and participation in a selected course or training programme included in the organiser's current offer. Any outstanding amount resulting, for example, from the difference remaining after payment of a non-refundable reservation fee must be paid by the Client by the specified final deadline before the start of the course or training programme, normally 45 days before the course. Payments may be made in cash, by money transfer, by card where online payment services have been activated, or by bank transfer to the account specified by the organiser. The payment should include the full name of the registered participant and the code/name of the selected course. For courses requiring a reservation fee, the first payment in the amount specified in the organisational details, normally PLN 1,000, must be made within 7 days of registration and/or issuance of a pro forma invoice. Payment is confirmed by the organiser's office by means of an appropriate invoice issued within 7 days of receipt of payment, but no later than the end of the relevant month. Failure to make the payment on time results in expiry of the reservation, including any additional arrangements previously made, and removal of the participant from the list. Two payment stages are established: the first up to three months before the scheduled course and the second from three months to one month before the course. If payment has not been received one month before the course, the organiser reserves the right to remove the participant from the participant list. After full payment of the course or training programme fee by the specified final deadline, the participant is entered on the main participant list and receives the appropriate invoice. Failure to record payment from the Client by or immediately after the applicable deadline, taking into account the time required for the transfer to be credited, may result in complete cancellation of the registration and reservation. For courses requiring a reservation fee, failure to make the payment on time results in expiry of the reservation and removal from the participant list. After full payment has been made, the organiser's office may, upon request, provide official confirmation in any available form that the conditions of registration and participation have been fulfilled. Such confirmation is not required in every case, and fulfilment of the applicable conditions by both parties may be presumed. Any costs of accommodation, meals and additional services exceeding the standard package, where the organiser has acted as an intermediary between the Client and a hotel, centre or other entity, shall be borne by the Client in accordance with separate individual arrangements. Services and Prices The type and scope of services provided under training programmes offered by the organiser are determined on the basis of information contained in informational and/or promotional materials and information published on the organiser's website. At the Client's request, the organiser is obliged to provide informational and/or promotional materials concerning courses or training programmes. Information contained in materials officially issued by the organiser is generally binding upon the organiser. Any information inconsistent with materials issued by the organiser or with participation confirmations concerning the provision of services shall not be binding upon the organiser. The organiser reserves the right to include advertising or promotional content during sponsored courses, including leaflets, participant information packs and short presentations for interested persons, as well as commercial stands located adjacent to or inside the lecture room, subject to additional arrangements and company policy. Prices for participation in courses or training programmes are expressed in Polish zloty (PLN). Discounts Discounts apply to students in their third to fifth year of study participating in courses of a primarily lecture-based nature. The type and amount of student discounts may be specified in informational and promotional materials issued by the organiser. If no separate student discount has been calculated and announced for a particular course or training programme, the lecture fee shall amount to 60% of the standard price. Where different prices apply to a particular course, for example due to a promotion or sponsored lecture, students may choose the more favourable option: either 100% of the promotional fee or 60% of the standard price. Promotional prices are not subject to any additional discount. To qualify for the discount, the participant must hold and present a valid personalised student ID card when registering immediately before the course. For practical classes, the student fee amounts to 80% of the standard price. Participant Cancellation, Changes to Reservations and Substitute Participants Before the start of a course or training programme, Clients may cancel their participation. A declaration of cancellation must be submitted by the Client on their own behalf and/or on behalf of participants registered by them, either verbally, for example by telephone, or in writing, including electronically, by letter or by fax. The date of cancellation shall be the date on which the cancellation is received by the organiser's office. If a Client or participant who has paid 100% of the participation fee cancels their participation or fails to attend for reasons beyond the organiser's control, cancellation costs shall apply in accordance with the conditions specified below. Cancellation charges per participant are: 45 to 30 days before the start of the course: 50% of the agreed price; 29 days or less before the start of the course: 100% of the agreed price. In justified cases involving unforeseen circumstances, considered individually, it may be possible to reduce the cancellation charge or waive the charge by means of a change to the reservation agreement, subject to the applicable conditions. Cancellation charges do not include reservation fees expressly designated as non-refundable. Such fees cannot be transferred to another course date and are always deducted in full. Any potential refund is calculated on the remaining balance. In justified cases involving unforeseen circumstances, and at the Client's request and subject to availability, it may be possible to change the date, location or, where applicable, subject of a course or training programme without additional charge, provided that the request is submitted to the organiser's office no later than 14 days before the course or within another period required by entities involved in organising the course, such as hotels or other venues. A change to the reservation agreement means a change to the date and/or location of participation in a course or training programme. Until the start of the course or programme, the Client may nominate another person or transfer the rights and obligations arising from these Regulations to a third party, unless the selected option was expressly restricted to a named participant. The Client is required to inform the organiser's office of any such change. Any administrative charges resulting from cancellation or changes to participation conditions by the Client or persons designated by the Client shall become payable immediately. Cancellation or Termination by the Organiser The organiser has the right to terminate the agreement to organise a course or training programme by providing the Client with an appropriate written or verbal statement if: the minimum or otherwise required number of participants specified by the organiser is not reached; or an unforeseen event constituting force majeure occurs. If the agreement is terminated for either of these reasons, the organiser undertakes to refund all amounts paid, including reservation fees, without any administrative charges. Liability Fizjoterapia i Klinika Stomatognatyczna Dr Małgorzata Kulesa-Mrowiecka undertakes to perform the agreement for the provision of training services with due care, taking into account the specialised nature of its activities. The organiser is responsible for: proper preparation and organisation of the course or training programme; proper performance of the services agreed upon under the agreement; ensuring that all services provided correspond to the descriptions contained in published information and promotional materials relating to the relevant courses or training programmes. Fizjoterapia i Klinika Stomatognatyczna Dr Małgorzata Kulesa-Mrowiecka accepts no responsibility or liability for content or information prepared by other persons or entities. 9. GENERAL PROVISIONS In matters not regulated by these Regulations, the provisions of the Polish Civil Code shall apply. These Regulations on participation shall enter into force on 20 July 2015.
